What We Do

Our Expertise

Relationship Property and Care of Children

We carry out all aspects of relationship property and care of children in which we have had a vast amount of success. For those entering into or leaving relationships, our work includes negotiating:

- Contracting out agreements
- Separation agreements
- Parenting agreements
- Settlement agreements

When things go wrong and cannot be resolved the next step is issuing proceedings in the Family Court for:

- Division of relationship property
- Interim distribution of funds
- Spousal maintenance
- Orders for care of children

Where possible we try to avoid litigation but often, separation can become acrimonious. If the dispute reaches the stage of litigation, we have years of experience and a thorough understanding of the law to obtain the best possible results for you.

At KooTelle Lawyers, we understand and have experience in dealing with the stress caused by the breakdown of personal and familial relationships and the legal issues that can arise.

Civil and Commercial Litigation

We are, and have been involved in a number of civil & commercial litigation cases across varying court jurisdictions, including:

- District Court
- High Court
- Court of Appeal
- Supreme Court
- Disputes Tribunal
- Employment Relations Authority
- Employment Court
- Immigration and Protection Tribunal
- Liquor Licensing Authority
- Sports Tribunal

This includes cases involving and acting for, large to small commercial entities in relation to:

- Contractual disputes
- Tortious disputes
- Trust disputes

Private Client

Property and Business Transactions
We can assist you with residential, commercial or business transactions. We consider all aspects of a transaction and help you put together a structure most suited to you. Amongst other things, we offer relationship property advice when you buy a property and employment advice in respect of your business transactions. We can provide services to help grow your business, protect your wealth, enforce your rights or defend your position.

We practice in the following areas:
- Sale and purchase of property and business
- Commercial and residential property conveyancing
- Commercial leases
- Financing
- Property sharing agreements
- Residential tenancies
- Construction contracts

Asset Protection and Estate Planning
We are here to help you structure your wishes so your assets are protected for you and your loved ones. We consider amongst other issues, your moral duty to your spouse and children before you make a Will, the pros and cons of settling your assets into a trust before you set one up, and the steps you need to take to protect your assets if your personal relationship goes wrong.

We can also assist in revising Wills once a relationship ends, which is important so that you can have more control over the destination of your assets. Additionally, we can assist with drawing up enduring powers of attorney. You cannot predict when you will be incapacitated through accident or illness but you can ensure that should any of these events happen, your property and your welfare rest in people you trust to manage.

Administration of Estate
Death of a family member is a stressful event. Applications to the High Court to obtain probate or letters of administration can be a long process which includes the filing of formal documents. If you have a Will, your executor will manage your estate. There could be delays while assets are sold or complex business and investment properties require final valuations and tax obligations to be met. Where there are no claims against an estate and the estate in given to immediate family members, in most cases an estate can be distributed between 6 to 9 months.

If you do not have a Will, an administrator will be appointed. The administrator is generally your spouse or your adult children or your other next of kin.
